Terms of Existence

1. Who May Use Existence

You must be at least 18 years old and able to enter into a binding legal agreement to use Existence. By using the service, you represent that the information you provide is accurate, current, and complete, and that you will use Existence only for lawful, personal, and genuine social connection.

2. Accounts and Profiles

You are responsible for maintaining the security of your device, account, and sign-in credentials. Profile text, photos, and videos must not be false, misleading, impersonative, abusive, infringing, or otherwise unlawful. You may not create an account for another person without permission or use Existence to deceive, harass, or target other users.

3. Hangouts and Messaging

Existence helps users discover nearby people, post hangouts, and exchange messages, but Types LLC does not supervise, screen in real time, endorse, guarantee, or insure any user, conversation, hangout, or in-person interaction. All hangouts and any decisions before, during, or after them are entirely at your own risk. Use good judgment, protect your safety, and do not rely on Existence as a background check, identity verification service, or emergency service.

4. Safety and Conduct

• No harassment, threats, hate speech, stalking, or coercive behavior.
• No fraudulent profiles, scams, or requests for illegal activity.
• No sexually exploitative content, non-consensual content, or unsafe solicitation.
• No posting content that violates intellectual property, publicity, or privacy rights.
• No attempts to reverse engineer, disrupt, overload, scrape, or bypass the service.

5. Moderation and Enforcement

We may investigate reports, remove content, limit visibility, suspend features, or suspend or terminate accounts if we believe that doing so helps protect users, comply with law, or maintain the integrity of Existence. We may take these actions with or without prior notice where appropriate.

6. Intellectual Property and License

Existence, including its software, branding, design, and content provided by Types LLC, is owned by Types LLC or its licensors and is protected by applicable law. We grant you a limited, non-exclusive, revocable, non-transferable license to use the app for its intended personal purpose. You retain rights in the content you submit, but you grant us a limited license to host, process, display, and use that content as needed to operate, secure, and improve the service.

7. Service Availability and Changes

Features may change, pause, or disappear as Existence evolves. We may modify, suspend, or discontinue all or part of the service at any time. We are not liable for outages, interruptions, delivery delays, or the failure of third-party providers such as Google, Neon, Vercel, Cloudflare R2, or Firebase Cloud Messaging.

8. Disclaimers and Limitation of Liability

Existence is provided on an “as is” and “as available” basis to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service will be uninterrupted, secure, or error-free. To the fullest extent permitted by law, Types LLC and its affiliates, managers, employees, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, goodwill, data, or business opportunities, arising from or related to your use of Existence, your interactions with other users, or any hangout.

9. Indemnity

You agree to defend, indemnify, and hold harmless Types LLC and its affiliates, officers, managers, employees, and contractors from and against claims, liabilities, damages, judgments, losses, and expenses arising out of or related to your content, your use of Existence, your violation of these Terms, or your violation of the rights of another person.

10. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Unless applicable law requires otherwise, any dispute arising out of or relating to these Terms or Existence must be brought exclusively in the state or federal courts located in or serving Sacramento, California, and you consent to the personal jurisdiction of those courts.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may post an updated version in the app or on the website and update the “Last updated” date above. Your continued use of Existence after the updated Terms take effect means you accept the revised Terms.
